Key Rules for the 45m² Exemption

The regulations (Class 3A “Auxiliary Habitable Dwelling” exemption) allow you to bypass planning permission if you meet strict site requirements:

The 25m² Rule: The development cannot reduce the remaining private open space reserved for the main home’s occupants below 25m².

Cumulative Space: The 45m² maximum includes the new modular home plus any existing relevant garden structures (like sheds or garages) already on the property.

Location: The modular home must be built strictly in the rear garden of your principal residence.

Height Restrictions: Maximum height is 4 metres for a tiled/slated pitched roof, or 3 metres for a flat roof.

Clearance: The structure must stand at least 0.6 metres away from any side or rear boundary fences.
